Welcome to Fetch Park (“Fetch Park,” “we,” “us” or “our”). These Terms of Use and Membership Agreement (“Terms”) govern your access to and use of FetchPark.com (the “Website”), any Fetch Park mobile application, and/or any Fetch Park locations, services, memberships or products (collectively, the “Services”). By accessing or using the Services — including browsing the Website, registering, purchasing a pass or membership, or visiting a Fetch Park — you accept and agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. How this Agreement Works

These Terms, along with our Privacy Policy and any other policies referenced herein, form the entire agreement between you and Fetch Park regarding the Services.

We may update these Terms at any time. The updated Terms will become effective immediately upon posting on the Website (or other notice, if applicable). Your continued use after posting constitutes acceptance of the changes.

Additional rules, policies, or guidelines (e.g., park-specific rules, safety protocols, membership addenda) may be posted elsewhere (on the Website or at a physical location); such additional terms may supplement or modify these Terms for relevant services.

2. Eligibility & Account Requirements

You must be at least 18 years old to use the Website or create an account.

You agree to provide accurate, current, and complete information when registering (name, contact info, payment info, dog vaccination status, etc.).

You’re responsible for maintaining the confidentiality of your account credentials and for any activity under your account.

3. Memberships, Payment & Billing Terms

Fetch Park may offer various passes and memberships (day-passes, monthly, annual, etc.) — current offerings and pricing are listed on the Website.

Memberships automatically renew (if applicable), unless canceled per the cancellation policy.

We reserve the right to change pricing, membership structure, terms, or offerings; such changes will apply to new and renewing customers, or as otherwise stated.

All payments must be by valid, authorized payment methods; you warrant that you are authorized to use the payment method provided.

Unless otherwise required by law, all sales — including memberships, day-passes, merchandise, and other services — are non-refundable.

4. Use of the Website & Intellectual Property

All content on the Website — text, images, design, logos, graphics, software, data, and other material (“Content”) — is owned or licensed by Fetch Park and protected by copyright, trademark, and other intellectual property laws.

You may use the Website and Content only for your personal, non-commercial use. You may not reproduce, distribute, modify, decompile, reverse engineer, or create derivative works without written permission.

If the Website allows user-generated content (reviews, photos, forum posts, etc.), such content must comply with policy; by submitting you grant Fetch Park a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify or otherwise make available your submitted content (on the Website, marketing, or other media).

5. Conduct, Use of Parks & Dog-Related Policies

5.1 Park Use & Dog Requirements

Dogs must meet all health and vaccination requirements and be free of contagious disease or conditions

Dogs must behave appropriately; Fetch Park reserves the right to deny entry, or to remove dogs and/or their owners, if behavior risks safety (aggression, excessive disruption, failure to follow rules, etc.).

Owners/guardians must supervise their dogs at all times, remain on-premises while their dog is present, clean up after their dog, and follow all posted or otherwise communicated park rules (leash rules, age/child supervision, prohibited items, etc.).

5.2 Prohibited Activities

You agree not to:

Violate any law, regulation, or third-party rights.

Upload or submit false, fraudulent, harmful, or unlawful content (including misleading vaccination records) or promote prohibited conduct (harassment, abuse, hate speech, spam, etc.).

Interfere with the operation or security of the Website or Services.

Misuse the Website or Services in any way that could impair them for others.

6. Assumption of Risk, Waiver, Release & Indemnification

You acknowledge that use of dog parks involves inherent risks — including injury to dogs or humans, interactions with other animals, or other unforeseen hazards.

By using the Services or visiting a park, you assume all risks related to your dog’s behavior, interactions, and presence on premises.

You hereby waive any claims against Fetch Park, its officers, employees, agents, and affiliates for injuries, damages, loss, or claims arising from your use of the Services or presence at any park — to the fullest extent allowed by law.

You indemnify and hold harmless Fetch Park (and related parties) from any and all claims, damages, losses or expenses (including legal fees) arising from your use of Services, breach of these Terms, or your dog’s conduct.

7. Disclaimer & Limitation of Liability

The Services (Website, memberships, park access, information, functionality) are provided “as is” and “as available.” Fetch Park makes no warranties — express or implied — regarding safety, accuracy, reliability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by law, Fetch Park is not liable for any direct or indirect damages, including loss of profits, data, goodwill, personal injury, or other losses arising from use of Services, park facilities, or reliance on any content or information.

If applicable law does not allow certain disclaimers or limitations, they may not apply to you — but any liability will be limited to the maximum extent permitted by law (e.g., amount paid in preceding 12 months).

8. Modifications, Suspension & Termination of Services

Fetch Park may modify, suspend, or discontinue any aspect of the Services (Website, app, park operations, membership offerings) at any time, with or without notice.

We are not liable for any modification, suspension, or termination.

We may also suspend or terminate your account or membership if you violate these Terms, fail to supply accurate information, or pose a safety risk.

9. Dispute Resolution & Governing Law

Arbitration & Class-Action Waiver: Any dispute or claim arising out of or relating to your use of the Services or these Terms will be resolved through binding individual arbitration, rather than in court. You waive any right to participate in a class action, class arbitration, or jury trial. This means all disputes must be brought on an individual basis. This provision is governed by the Federal Arbitration Act and applies to all claims between you and Fetch Park, except where prohibited by law or for eligible small-claims matters.

Governing Law: The Terms shall be governed by the laws of the state where the applicable Fetch Park location operates, without regard to conflict-of-laws provisions.

Severability: If a court finds any part of these Terms invalid or unenforceable, that part will be severed/modified to the minimum extent needed — the rest remains in effect.

10. Electronic Communications & Notices

By using the Website or Services, you consent to receive communications electronically (e.g., email, in-app messages, push notifications).

These communications (notices, agreements, updates, billing statements) satisfy any legal requirement for written communication.

It is your responsibility to maintain a valid, active email address or contact method on file.

11. Privacy and Data Use

Use of the Services is also governed by our Privacy Policy (linked separately), which describes how we collect, store, use, and share your personal information.

By using the Services, you consent to these data practices as described in the Privacy Policy.

12. Additional Terms & Third-Party Content

The Website or Services may include links to third-party websites, tools, or apps (vendors, software, integrations). Use of third-party content is subject to the third party’s own terms and privacy policies — Fetch Park is not responsible or liable for them.

If you choose to connect or use third-party tools/apps, you consent to any data sharing required for integration under those third parties’ terms.

13. Miscellaneous

Entire Agreement: These Terms, the Privacy Policy, and any additional posted/rule-based terms are the full agreement between you and Fetch Park regarding the Services.

Waiver: Our failure to enforce any right under these Terms does not waive that right for future enforcement.

Headings, Interpretation: Section headings are for convenience only and do not affect interpretation of the Terms.
